By registering and utilizing our services, you agree to the following terms and conditions outlined in this document, which is effective as of the date you purchase services from Cloudrift. This Agreement sets forth the terms and conditions of your use of Cloudrift’s Dedicated Server services (collectively, the “Services”) and represents the entire agreement between you and Cloudrift relating to the Services. By purchasing the Services, you acknowledge and agree that you have read, understood, and agree to be bound by all the terms and conditions of this Agreement, along with any new, different, or additional terms, conditions, or policies that Cloudrift may establish and post on its website from time to time.

Cloudrift Service

  • Cloudrift reserves the right to decline services and goods to the customer.

  • Cloudrift reserves the right to perform notified maintenance on all services provided to the client and, wherever possible, will provide advance notice of such maintenance.

  • The customer must ensure they provide Cloudrift with a valid name, address, telephone, and email contact.

  • The customer must ensure their usage of the service provided by Cloudrift is within the guidelines set out in the Cloudrift Acceptable Usage Policy (AUP).

  • Unless otherwise stated, the service Cloudrift provides is unmanaged. Although the company may attempt to provide support for any third-party software and programs, no guarantee is made on the level of support for such software.

  • Any problems caused by the customer to the service (which include, but are not limited to, deletion of necessary operating system files, accidental or intentional infection by a virus/Trojan) may result in extra charges to the client.

  • Cloudrift shall have the right, upon prior written notice, to relocate the customer’s equipment. In the event of an emergency, Cloudrift may relocate the customer’s equipment within a reasonable time and without prior notice, as warranted by the circumstances.

Payments and Termination

  • The customer shall pay the charges for the services as set out during signup on the order form.

  • The customer is entering a thirty-day monthly rolling contract unless otherwise specified in an additional service agreement between Cloudrift and the customer.

  • The customer shall provide no less than three days’ cancellation notice before their billing anniversary date. This notification must be sent via:

    • Email: support@Cloudrift.net

    • Recorded post to Cloudrift’s registered office

    • Cancellation support ticket via the customer control panel at https://cloudrift.net/

  • Cloudrift shall be entitled, 30 days before and at any time after the expiry of the service term, to increase service charges upon 30 days’ written notice to the customer.

  • Cloudrift shall invoice the customer 14 days before their service renewal date unless otherwise agreed.

  • All invoices must be paid within 14 days of issue unless otherwise stated in a separate agreement.

  • Cloudrift reserves the right to suspend and/or disconnect any services for a customer with unpaid invoices beyond their due date.

  • Cloudrift also reserves the right to prohibit access to customer equipment or data if payments are overdue.

  • Interest shall accrue on overdue invoices at a rate of 1.5% per month, from the due date until payment is made, even after service termination.

  • All amounts payable to Cloudrift are exclusive of Value Added Tax (VAT) or other applicable taxes, which shall be added at the prevailing rate.

  • The customer acknowledges that their obligation to pay Cloudrift is absolute, unconditional, and irrevocable, regardless of any set-offs, disputes, or claims.

  • Upon cancellation of service, Cloudrift will not provide any refunds for services already provisioned.

  • Any billing disputes must be submitted to Cloudrift no later than 3 days after the invoice due date.

  • Customers will be notified via email when they reach 80% of their monthly data transfer allowance. Cloudrift cannot guarantee delivery of this email. Customers should monitor their bandwidth usage using the graphs and reports in their control panel.

  • Customers who exceed their data transfer limit will be automatically charged at $0.05/GB for additional usage.
